TERMS OF SALES

The following provisions establish the General Conditions of Sale of the products offered by the company LIP hereinafter referred to as "Joée" on its website at the following address: www.joee.fr .

Sarl LIP is a company with a capital of 8000 € whose head office is located at 7 rue Bachaumont 75 002 and registered with the RCS of Paris under the number of SIREN 524 121 613. By clicking on "order and pay" you definitively confirm your purchase and fully accept the General Conditions of Sale. Joée makes it impossible to sell a product without having first accepted the clauses below.

ARTICLE 1

PURPOSE: These conditions aim to define the terms of sale between Joée and the customer, from ordering to services, including payment and delivery. They regulate all the stages necessary for the placing of the order and ensure the follow-up of this order between the contracting parties.

ARTICLE 2

PRODUCTS: Joée's vocation is to offer for sale jewelry and fashion accessories, shoes, bags, stoles, pouches within the limits of available stocks. These products are those listed for sale on the day of consultation by the customer. When the product is unavailable, it is displayed on the site, otherwise, in the event of an error, Joée undertakes to notify the customer by e-mail as soon as possible. If the product has already been paid for, Joée undertakes to reimburse the customer for the price of the item.

The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, Joée cannot be held liable.

The photographs and texts illustrating the products do not enter into the contractual field.

ARTICLE 3

PRODUCT PRICES: The prices are indicated in euros. They take into account French VAT, applicable on the day of the order. If the VAT rate were to be changed, these changes would be reflected in the price of the items. Joée reserves the right to modify its prices at any time. However, these prices cannot be modified once the order has been confirmed. The prices indicated do not take into account the shipping costs which will be added to the total of the order and will be specified to the customer during the final validation of his order.

Delivery in mainland France is made within an average period of 2 to 5 days from receipt of the order by Joée notwithstanding any fortuitous event or force majeure which would delay delivery regardless of Joée's will and diligence. Its amount is set according to the country of destination and the mode of transport chosen.

The products remain the property of Joée until full payment of the price.

ARTICLE 4

REGISTRATION OF AN ORDER: The customer who places an order directly on the site www.joee.fr must follow the procedure: The customer must first create a customer account; He will then choose the different products in which he is interested and will successively click on the link "Add to my basket"; At any time he will have the possibility: either to obtain a summary of the selected products by clicking on the link "My basket" or to continue his purchases; The customer will complete his order by clicking on "order and pay".

In order to correctly validate his order, the customer must fill in the following fields: title, surname, first name, complete delivery / billing address, e-mail and telephone number. It then specifies the chosen delivery method. The order can only be registered on the site if the customer has clearly identified himself by entering his e-mail address and password which are strictly personal to him. Once the customer has been identified, he must validate the delivery address and then an order form will appear summarizing: the nature, quantity and price of the products selected by the user, as well as the chosen payment method, the contact details of the customer. user and the delivery address of the package. Any order implies acceptance of the prices and description of the products available for sale.

VALIDATION OF THE ORDER: The order is validated once the General Conditions of Sale and all the fields completed by the customer have been read and approved. The order is final when the customer clicks on "order and pay". Payments are made either by PayPal or by credit card. The customer confirms his address, the product (s) and the total price of his order, including shipping costs. In all cases, whatever the method of payment chosen by the customer, Les Javottes will acknowledge receipt of the order as soon as it has been confirmed by email.

ARTICLE 5

PAYMENTS AND SECURITY OF PAYMENTS : The amount owed by the customer is the amount indicated during the order confirmation validated by the action "order and pay".

Payment will be made on the Internet on the site www.joee .Fr by Credit Card (Blue, Visa, Eurocard / Mastercard) or by PayPal.

In order to ensure the security of credit card payments, the site www.joee.fr uses the secure payment service of La BRED. The confidential data (the 16-digit bank card number, the expiration date and the visual cryptogram) are directly transmitted encrypted to the payment platforms concerned without passing through the physical media of the Joée server.

For payments via PayPal, Joée declines all responsibility in the event of loss of data from the PayPal company and cannot be engaged in a process of compensation, which would be due by PayPal.

In any case, Joée reserves the right to refuse any order or any delivery in the event of an existing dispute with the customer, total or partial non-payment of an order, a refused payment by credit card or for reasons other than Joée will reserve the right to explain to his client. The responsibility of Joée can in no case be engaged in this respect. When the order is validated, the payment request is routed in real time to the secure electronic payment manager. This sends an authorization request to the bank card network. The electronic payment manager issues an electronic certificate.

You acknowledge that the "double click" associated with the checkbox on becoming aware of the general conditions constitutes consent to contract and constitutes an irrevocable and unreserved acceptance of the general conditions of the product.
Unless proven otherwise, the data recorded by Oney Bank constitutes proof of all transactions between you and Oney Bank.
If you request to benefit from a financing solution offered by Oney Bank, the information relating to your order will be transmitted to Oney Bank, which will use it for the purpose of studying your request for the granting, management and credit recovery. Oney Bank reserves the right to accept or refuse your request for 3x 4x Oney financing. You have a 14-day withdrawal period to give up your credit.

Functioning : Payment in 3 or 4 times by credit card allows you to pay for the order made on our merchant site as follows

  • - a mandatory contribution, debited on the day of confirmation of the shipment of your order corresponding to a third or a quarter of the order, to which are added costs corresponding to 1.45% of the total amount of the order for a 3 times and at 2.2% for 4 times (within the limit of € 15 maximum for payment in 3 installments and € 30 maximum for 4 installments);

  • - two or three monthly installments, each corresponding to a third or a quarter of the order, taken 30 and 60 days later for the 3 times and 30, 60 and 90 days after for the 4 times.

ARTICLE 6

DELIVERY: The products are shipped with the supporting invoice, to the delivery address indicated by the customer when ordering. All orders validated before 1 p.m. are shipped the following working day. The delivery times indicated are indicative times from the day following that of the validation by the customer of his order and correspond to the processing and delivery times of the products. In no case can they be opposable, but in the event of unusual delay, an email will be sent to you. Joée therefore declines all responsibility in the event of an excessively long delivery time due to postal services or means of transport, as well as in the event of loss of the products ordered or of a strike. The risks of transport are borne by the customer, who must formulate a reasoned protest to the postal services or to the carrier, within three working days of delivery. Likewise, after transporting the package, one of the products may prove to be defective. This is why, upon receipt of his order, the customer will check the conformity of the products received. Any anomaly concerning the delivery (missing or broken product, damaged package) must imperatively be notified, on the same day of receipt or at the latest on the first working day following receipt, to Joée customer service, by registered mail (addressed to Joée / sté LIP - Customer Service - 69 rue d'argout, 75002 Paris). Each customer can follow the delivery status of his package in the "My Account" section. Any complaint made after this deadline will be rejected and Joée will be released from all liability. Joée reserves the right to ask the customer to return the defective product. If the aforementioned conditions are met, Joée will then proceed with the exchange, refund of the defective product (s), or reshipment of the missing product ( subject to the merits of the customer's request).

DELIVERY TIMES: The times indicated are the indicative delivery times of our carriers in working days. Standard = La Poste (colissimo followed). Express = chronopost delivery against signature. All the products presented on the site correspond to our real and immediate availability. All prices are in euros. The tracked colissimo is delivered by La Poste in 2 to 5 working days (for metropolitan France). It is delivered to the delivery address indicated on your order form. In case of absence, the postman leaves you a calling card, indicating the conditions of withdrawal of your package (place and time). The time limits for proceedings are generally 15 days. In order to have your colissimo number, please send an email to contact@joee.fr by specifying your first and last name. If you have not received your tracked colissimo after 5 days and you have not been left with a delivery notice, remember to check the status of your package on the coliposte website (and contact us by e-mail contact@joee.fr ). Damaged package: We ask you not to receive a damaged package (cardboard with visible signs of opening and / or deterioration). It is imperative to refuse it. Indeed, packages leaving Joée's offices are always impeccable, and must be delivered to you in this condition. If a damaged package has been left in your mailbox or your caretaker has received it, the package is considered "accepted as is". If no reservations have been made, we will not be able to take into account the possible disappearances, nor to proceed to compensation. ARTICLE 7

GUARANTEES: All products can be reimbursed except for those bearing a contrary mention. The refund must be made within 14 days from the date of receipt of the order and the return of the item (s) within this period must be accompanied by the original invoice. The item (s) must be returned in their original packaging to the following address: Joee / LIP company 69 rue d'Argout - 75002 Paris.

If the customer wishes a refund, it is essential that he makes a return request by e-mail ( contact@joee.fr ) so that Joée validates this request.

The return is free for mainland France only.

Any damaged item which has not been the subject of comments or express reservations by the customer upon delivery will be refused by the seller. To be accepted by Joée, original items and packaging must be returned in their original condition without having been worn or washed. Consequently, returns of washed and / or worn clothes, damaged or scratched jewelry as well as damaged boxes will be refused. Joée thus reserves the right to accept or refuse the returned item depending on its qualitative condition. All items are subject to a contractual guarantee, which does not preclude the legal guarantee provided for by articles 1641 and following of the Civil Code. The user benefits from a guarantee for the articles allowing him to return the defective delivered articles in accordance with articles L 211-4 and following of the Consumer Code.

THE EXCHANGE: In view of the limited stocks, we cannot undertake to proceed to an exchange. However, if you want a new size or another color, you just have to place an order again on the e-shop. In this case, the shipping costs will be refunded to you on request by e-mail.

REIMBURSEMENT: Reimbursements can also be requested within 7 days from the date of receipt of your complaint, if it was purchased on the site. www.joee.fr . Joée undertakes to reimburse within a maximum period of 30 days by the means of payment initially used by the customer when ordering. If you would like a refund for your item, send an email to contact@joee.fr . Indicate your name, first name, telephone number, order number and the reason for your return. Return the package by Colissimo followed by the Post Office to the Joée / LIP company e-shop address: 69 rue d'argout - 75002 Paris. Please note that we do not accept parcels sent postage due. The customer must return the item as is in its original packaging with its return number included in the package giving a certain date for this shipment. In all cases, any refund request must be made by e-mail (My Account / Returns section). All items are subject to a contractual guarantee, which does not preclude the legal guarantee provided for by articles 1641 and following of the Civil Code.

PLEASE NOTE, during private sales and exceptional promotions, items are taken back against credit only.

ARTICLE 8

INTELLECTUAL PROPERTY: All elements of the site www.joee.fr , such as visuals are protected by copyright, trademarks or patents. They are the exclusive property of www.joee.fr . In all cases, any link, even tacitly authorized, must be withdrawn at the simple request of Joée.

ARTICLE 9

INFORMATION TECHNOLOGY AND FREEDOMS: For the needs of its activity, Joée reserves the right to collect personal data relating to users of the site, in particular by means of "cookies". The consumer acknowledges having knowledge of it. In accordance with the provisions of Law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms, and the decision of the CNIL (Commission Nationale Informatique et Liberté) of July 10, 2006 to remove the obligation website declaration for the benefit of the processing declaration procedure associated with said site.

This agreement is subject to French law. And in the event of a dispute with a customer, the French courts will have sole jurisdiction.

ARTICLE 12

INTEGRALITY OF THE CONTRACT: These General Conditions of Sale and the order summary sent to the customer form a contractual whole and constitute the entirety of the contractual relations between the parties.
